Terms of Service

1. Agreement to Terms

By downloading, installing, or using ShiftEarn ("the App"), you agree to these Terms of Service ("Terms"). If you don't agree, please don't use the App.

These Terms apply to:

• The ShiftEarn mobile application
• The ShiftEarn website (shiftearn.app)
• Any related services, features, or content

2. Who Can Use ShiftEarn

To use ShiftEarn, you must:

• Be at least 16 years old
• Be capable of forming a binding contract
• Not be prohibited from using the App under applicable laws

If you're using ShiftEarn on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Your Account

3.1 Account Creation

ShiftEarn can be used without creating an account. All features work with local-only storage. However, if you want to use cloud backup, you'll need to create an account.

3.2 Account Security

If you create an account, you're responsible for:

• Keeping your password secure and confidential
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

3.3 Account Termination

You can delete your account at any time from Settings. When you delete your account:

• All cloud backup data is permanently deleted
• Local data on your device remains unless you delete it
• Any active subscriptions will be cancelled

4. Free and Pro Plans

4.1 Free Plan

The Free plan includes:

• Unlimited shift tracking
• 30-day history access
• 1 job
• 1 goal, 1 template
• 5 expenses, 2 paychecks
• Basic stats (Week/Month periods)
• Tip calculator
• Dark/Light mode
• Local data storage

The Free plan is ad-free by default. We believe your core tip-tracking experience should never be interrupted.

4.2 Pro Plan

The Pro plan includes everything in Free, plus:

• Unlimited history access
• Unlimited jobs
• Unlimited goals & templates
• Unlimited expenses & paychecks
• Compare tool
• Insights & analytics
• Year period access
• Data export (CSV/PDF)
• Cloud backup & sync

4.3 Pricing

• Pro Monthly: $2.99 per month
• Pro Yearly: $19.99 per year (save 44%)

Prices are in USD and may vary by region. Applicable taxes may apply.

4.4 Billing & Renewals

• Subscriptions are billed through your App Store or Google Play account
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage and cancel subscriptions in your device's app store settings

4.5 Refunds

Refunds are handled by Apple (App Store) or Google (Google Play) according to their respective refund policies. We're happy to help facilitate refund requests - just contact us.

5. Acceptable Use

You agree to use ShiftEarn only for lawful purposes. You may NOT use the App to:

• Violate any laws or regulations
• Infringe on others' intellectual property rights
• Attempt to reverse engineer, decompile, or hack the App
• Introduce malware, viruses, or harmful code
• Attempt to access other users' data
• Use the App to harass, abuse, or harm others
• Misrepresent your identity or affiliation
• Use automated systems to access the App without permission

6. Your Data

6.1 Ownership

Your data is yours. You retain full ownership of all data you enter into ShiftEarn, including shift records, earnings data, and personal information.

6.2 License to Us

By using cloud backup, you grant us a limited license to store and transmit your encrypted data solely for the purpose of providing the backup service. We cannot read your encrypted data.

6.3 Data Portability

You can export your data at any time (Pro feature) and take it with you. We believe in data freedom.

6.4 Data Accuracy

You are responsible for the accuracy of data you enter. ShiftEarn provides tools for tracking - we don't verify or guarantee the accuracy of your records.

7. Intellectual Property

7.1 Our Property

ShiftEarn and its contents (excluding your data) are owned by us and protected by copyright, trademark, and other laws. This includes:

• The App's design, code, and functionality
• The ShiftEarn name, logo, and branding
• All text, graphics, and user interface elements

7.2 Your License

We grant you a limited, non-exclusive, non-transferable license to use ShiftEarn for personal, non-commercial purposes in accordance with these Terms.

7.3 Feedback

If you provide feedback or suggestions, we may use them to improve the App without any obligation to you.

8. Disclaimers

8.1 "As Is" Service

ShiftEarn is provided "as is" and "as available" without warranties of any kind, either express or implied. We don't guarantee that the App will be error-free, uninterrupted, or meet your specific requirements.

8.2 Not Financial or Tax Advice

Important: ShiftEarn is a tracking tool, not a financial advisor or tax service. The App does not provide:

• Tax advice or tax preparation services
• Financial planning or investment advice
• Legal advice regarding employment or earnings
• Official records for tax filing purposes

Consult qualified professionals for tax, legal, or financial advice. Your ShiftEarn data is for personal reference only.

8.3 Data Loss

While we take precautions to protect your data, we cannot guarantee against data loss. We strongly recommend:

• Enabling cloud backup for important data
• Regularly exporting your data (Pro feature)
• Keeping your device backed up through your device's backup service

9. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $50, whichever is greater
• We are not liable for any loss of data, profits, or business opportunities

Some jurisdictions don't allow certain liability limitations. In those cases, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to indemnify and hold harmless ShiftEarn, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

11. Changes to the App

We may modify, update, or discontinue features of ShiftEarn at any time. We'll try to give advance notice for significant changes, but we're not obligated to do so. Your continued use after changes constitutes acceptance.

12. Changes to Terms

We may update these Terms from time to time. When we make significant changes:

• We'll update the "Last Updated" date
• We'll notify you through the App or by email (if provided)
• Continued use after changes means you accept the new Terms

If you disagree with changes, you can stop using the App and delete your account.

13. Termination

We may suspend or terminate your access to ShiftEarn if you violate these Terms or engage in conduct we determine is harmful to other users, us, or third parties. Upon termination:

• Your license to use the App ends immediately
• You remain responsible for any outstanding charges
• Sections of these Terms that should survive will survive (like limitations of liability)

14. Dispute Resolution

If you have a dispute with us:

1. Contact Us First: Email us at legal@shiftearn.app. Most issues can be resolved quickly.
2. Informal Resolution: We'll try to resolve disputes informally within 30 days.
3. Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration, not in court (except for small claims).

No Class Actions: You agree to resolve disputes individually, not as part of a class action or representative proceeding.

15. General Provisions

• Entire Agreement: These Terms (plus our Privacy Policy) constitute the entire agreement between you and ShiftEarn.
• Severability: If any provision is found unenforceable, the rest remains in effect.
• No Waiver: Our failure to enforce a provision doesn't waive our right to enforce it later.
• Assignment: You can't assign your rights under these Terms. We can assign ours in connection with a merger or acquisition.
• Governing Law: These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law provisions.
